ANJ Issues Record Fine to SPS Betting Over Self-Exclusion Failure
The Autorité Nationale des Jeux (ANJ), France’s gambling regulator, has recently imposed a historic fine of EUR 800,000 on SPS Betting, the operator of the Unibet brand in France. This significant penalty was issued due to a serious self-exclusion failure that occurred within the Unibet platform, highlighting the gravity of the issue at hand.
ANJ’s Largest Fine Yet
According to the ANJ, the Unibet brand experienced a critical malfunction related to self-exclusion, allowing self-excluded players to continue placing bets over an extended period. This technical flaw specifically affected iOS users and persisted for almost two years, from March 2021 to December 2022, putting vulnerable individuals at risk of potential gambling harm.
The ANJ estimated that around 100 players might have used the betting services during this time, although SPS Betting claimed the issue impacted over 4,500 player accounts, with ANJ citing a higher number of 6,754. Despite the discrepancies in figures, SPS Betting acknowledged the breach and did not dispute the regulator’s findings.
Severe Violation
Due to the severity of the breach, the ANJ decided to impose its largest fine to date on SPS Betting. The extended duration of the malfunction, coupled with ineffective initial remediation measures, contributed to the hefty penalty. The ANJ stressed the importance of upholding self-exclusion protocols in the online gaming sector, emphasizing the need for strict compliance across all operators.
Additionally, Unibet had previously faced fines in France for breaching the country’s return to player (RTP) limit of 85%, further warranting the latest penalty. The operator has been given a two-month window to appeal the decision and is mandated to display a notice regarding the fine on its homepage.
Unibet’s Challenges in the Netherlands and France’s Tax Adjustment
Aside from the regulatory issues in France, Unibet also encountered scrutiny in the Netherlands for attempting to block lawsuits from former players seeking compensation for losses incurred before the company obtained regulatory approval in the country. Meanwhile, France’s gambling market recently underwent a tax increase on specific products, despite initial considerations to abandon the tax hike proposal.
